Intellectual Property Law
Trademark registration is handled by the Kenya Industrial Property Institute (KIPI). The process involves filing an application, examination, publication in the Kenya Gazette, and registration. The process typically takes 12–18 months. We recommend filing as early as possible to establish priority. Our IP team manages the entire process on your behalf.
Copyright in Kenya protects original literary, artistic, musical, and audio-visual works, as well as sound recordings and broadcasts. Protection is automatic upon creation of the work — no registration is required. However, registration with the Kenya Copyright Board (KECOBO) provides useful evidentiary benefits. Our IP team advises on licensing, enforcement, and commercialisation of copyrighted works.
Data Protection
Organisations that collect, process, or store personal data in Kenya must register as data controllers or processors with the Office of the Data Protection Commissioner (ODPC), implement appropriate security measures, appoint a Data Protection Officer where required, and comply with data subject rights including access, rectification, and erasure. Our Data Protection team provides compliance assessments, policy drafting, and ongoing advisory.
Cross-border data transfers are permitted only to countries that provide an adequate level of data protection, or where appropriate safeguards are in place such as standard contractual clauses. The ODPC has issued guidance on this. Our team advises on structuring compliant international data transfer arrangements.
Conveyancing
A typical property transaction involves: due diligence and title searches, drafting and negotiating the sale agreement, obtaining requisite consents (e.g. Land Control Board for agricultural land), stamping and registration of transfer documents, and registration of the new title. Our team handles the full process from offer to title, typically within 60–90 days for straightforward transactions.
Environmental Law
Under the Environmental Management and Coordination Act (EMCA) and NEMA regulations, an EIA is required before commencing any project likely to have a significant environmental impact — including construction, manufacturing, agriculture, and energy projects. Our Environmental Law team advises on EIA preparation, NEMA licensing, and environmental compliance throughout the project lifecycle.
Food Law & Practice
Food safety in Kenya is regulated primarily by the Kenya Bureau of Standards (KEBS), the Ministry of Health, the Kenya Food and Drugs Authority (KFDA), and the Agriculture and Food Authority (AFA). Businesses must comply with standards on labelling, packaging, hygiene, and product approval.
